General Terms and Conditions of sale of the site hylos.fr
The sounds diffused by HYLOS are the result of many years of research and represent the intellectual property of HYLOS sas. Any use not authorized by these GTC shall be subject to a written and signed agreement.
1. ACCEPTANCE OF THE TERMS AND CONDITIONS
The Customer acknowledges having read and understood the following terms and conditions of sale at the time of placing the order and expressly declares that it accepts them without reservation.
These general terms and conditions of sale shall prevail over any other terms and conditions contained in any other document or pages of the Site, unless expressly agreed otherwise in writing.
HYLOS SAS reserves the right to adapt or modify at any time the present general conditions of sale. In case of modification, the general terms and conditions of sale in force on the day of the placing of the order shall apply to each order.
2. ORDER
The automatic recording systems implemented by HYLOS sas shall be considered as proof of the nature, content and date of the order.
HYLOS sas shall confirm the acceptance of the order to the Customer at the e-mail address provided by the Customer. The order shall constitute an offer to purchase by the Customer and the sale shall only be concluded upon dispatch of the order.
HYLOS sas reserves the right to cancel any order.
The information provided by the Buyer when placing an order shall be binding upon the Buyer. In the event of an error in the wording of the address and telephone number of the recipient, the seller shall not be held responsible for the impossibility of delivering the product.
3. DELIVERY
The cost of delivery, which takes into account the delivery address given by the Customer, is calculated before the final validation and is integrated in detail in the agreed price. It is only the cost of transport and does not take into account any import taxes outside the European Union.
Delivery shall be made by mail. HYLOS sas shall in no event be liable for any delays or malfunctions due to the carrier.
Home deliveries shall be made within the usual time slot of the carrier by direct hand delivery against signature. Any delays resulting from the absence of the Customer at the place of delivery during the passage of the carrier do not give the right to the buyer to claim damages, the date of first presentation at the delivery address indicated by the Customer at the time of his order being considered as the effective date of delivery.
For all shipments outside the European Union, the customer will have to pay any import fees or customs taxes. We will invoice excluding VAT according to the legislation.
War, riot, fire are considered as force majeure discharging the seller from his obligation to deliver,
We invite you to verify the apparent state of the products upon delivery with the delivery man. Whatever the carrier and in the presence of an apparent anomaly (damage, damaged package, etc.), you must unpack the package in the presence of the deliveryman and write detailed handwritten reserves by having the delivery man sign next to it. The reserves taken by the recipient at the delivery constitute means of proof of the existence and the importance of the damage. Make sure to be precise and complete in their writing (the simple mention "subject to unpacking" is considered too general and imprecise), and inform the company by registered mail within three (3) working days following the delivery of your package.
4. RETURN AND BUY-BACK OFFER
The customer has a legal period of 14 clear days to exercise his right of withdrawal from the date of receipt of the goods without having to justify reasons or pay penalties. Returns on the used product are only possible once per customer and delivery address, so there is only one possible trial period, not several.
The item to be returned must be intact, complete and packed in its original box.
The refund of the returned products will be made within 14 days from the receipt of the return. The refund will be made by check or bank transfer. The amount of the refund is equal to the amount of the purchase minus the shipping costs, in other words we refund the price of the product. Any request for a return for refund made outside of the 14 day trial period will be refused.
SATISFIED OR REFUNDED:
Offer reserved for residents of the European Union.
The customer has 2 months to use the device. At the end of the 2 months, and at his request, the device is taken back and refunded with a discount due to its use.
This offer is only valid for the white model with a value of 635 € and for a cash purchase. Our commitment: To take back your Hylos device (if it is in perfect condition) within a maximum of 2 months after your purchase, for the sum of 425€ TTC
HOW TO DO :
Notify us by e-mail and attach your IBAN that you wish to resell your device.
Send it back to us by colissimo with a tracking number to our address
After having noted its good visual condition and operation, we will issue a transfer of 425 € in your favor.
Please note that if the order is a cash purchase the transfer will be immediate, if it is a purchase in 4 times without charge the transfer will be made after the last payment.
5. PRICES
The prices are indicated in euros including or excluding VAT depending on the destination.
These prices do not include a fixed contribution to shipping costs.
They take into account the VAT applicable on the day of the order.
The articles remain the property of HYLOS sas until full payment is received by HYLOS sas.
6. PRODUCT, USE AND WARRANTY
Hylos devices are manufactured in France and comply with European standards 60601-1 and 60601-2.
They are only designed for domestic use on humans and animals. The use by a health and well-being professional is authorized but is done under his entire responsibility. Any other use is forbidden, especially industrial use. The latter will have to be the object of an adaptation of the HYLOS process to the case considered and of a contract of licence or service.
The products sold are guaranteed against any manufacturing defect in accordance with the law. In addition, the purchaser shall be granted a two-year warranty provided that the provisions set forth in the operating instructions are complied with, including, but not limited to, intentional or unintentional damage to the device. This guarantee does not cover goods damaged by accident or use contrary to those prescribed.
The invoice serves as a guarantee.

7.PAYMENT
The price charged to the Customer shall be the price indicated on the order confirmation sent by HYLOS sas. The price of the products shall be payable in cash on the day of the effective order (except for deferred payments)
7.1 CREDIT CARDS
Credit card payments are authorized and processed by the Crédit Industriel et Commercial in France. We use a secure transactional site to send the credit card data to CM-CIC.
7.2. CHEQUE
Orders are validated and shipped upon receipt and validation of the check.
7.2. CHECK IN 4 TIMES WITHOUT EXPENSES
We propose a payment split in 4 times by check. The customer sends 4 checks of 1/4 of the amount of the order. The first check is cashed upon receipt and the other 3 at 30, 60 and 89 days.
7.3 TRANSFER
If payment is made by bank transfer, the customer shall be responsible for making the transfer within 7 days. The bank details of HYLOS sas shall be communicated to the Customer at the time of the order and by electronic means. For transfers from abroad, the bank charges shall be borne by the customer.
8. LITIGATION
This Agreement shall be governed by French law.
HYLOS sas cannot be held responsible for damages of any nature which could result from the bad use of the marketed product. The Company shall not be liable for any errors or omissions which may have occurred despite all precautions taken in the presentation of the product.
The Customer understands that health or other advice given by representatives of HYLOS sas shall not be used as a substitute for professional medical advice. The use of products marketed by HYLOS sas shall not be used as a substitute for medical treatment prescribed by a physician.
In the event of a dispute, only the Commercial Court of Carcassonne shall have jurisdiction.
